Welcome to our website, a website hosted and operated by Allan Scott Family Winemakers. These terms apply to the entire contents of the site. By viewing and using the site, you will be deemed to agree to these Terms and Conditions. If you do not agree, please do not use our website.

1. About Us

This website is operated by Allan Scott Family Winemakers. We are a New Zealand based winery and hospitality business offering wine sales, bistro dining, events, weddings and related experiences.

2. Use of Our Website

You may use this website for personal and lawful purposes only.

You agree not to:

  • misuse or interfere with the website or its functionality

  • attempt to gain unauthorized access to any part of the website

  • use the website in a way that breaches New Zealand law

We may suspend or restrict access if the website is being used inappropriately.

3. Wine Sales & Age Restriction

You may only use this website if you are of legal drinking age in your country of residence. You must exit the website if you do not meet this requirement. Alcohol is sold on this website in accordance with New Zealand law. 

  • You must be 18 years or older to purchase alcohol.

  • By placing an order, you confirm that you are legally entitled to buy alcohol.

  • We may request age verification before dispatch or delivery.

We reserve the right to refuse or cancel any order where age requirements are not met.

4. Orders & Payments

The online store processes all credit card transactions using the Windcave e-commerce payment solution. Your credit card details are not stored for future use and are processed in a secure environment. We accept payment via Visa, Mastercard, credit card and PayPal.

  • All prices are shown in NZD and include GST unless stated otherwise.

  • Orders are subject to availability and acceptance.

  • We reserve the right to cancel orders due to pricing errors, stock issues, or suspected misuse.

Online sales are currently intended for New Zealand customers only, unless otherwise stated.

5. Shipping

Flat rate shipping is $8.50. Freight included if your order value is $100 NZD or more. Not applicable for fundraisers. Orders are processed at the end of each day (Monday to Friday). Orders made on the weekend will be processed the next business day. Order dispatch will be confirmed with an automated freight provider email. Delivery timeframes are estimates only. We are not responsible for delays caused by couriers, weather events, or other factors outside our control. Risk of loss passes to you once your order has been dispatched. 

6. Refunds & Returns

We comply with the Consumer Guarantees Act 1993.

  • We guarantee the quality of all our products. If you are dissatisfied in any way with your purchase, please contact us within 30 days of your purchase with the details of the problem. If for any reason a product is found to be faulty or defective, Allan Scott Family Winemakers will arrange for collection of the product and the cost will be fully refunded.

  • Change-of-mind returns are not required by law and are offered at our discretion.

  • Event tickets, wedding bookings, and other experiences may have specific cancellation and refund terms, which will be provided at the time of booking.

Please contact us as soon as possible if there is an issue with your order.

7. Bistro, Events & Weddings

Bookings for our bistro, events, tastings and weddings may be subject to additional terms, including:

  • deposits

  • minimum spend requirements

  • cancellation and rescheduling policies

These terms will be clearly communicated during the booking process and form part of your agreement with us.

8. Website Content & Intellectual Property

All content on this website including text, images, videos, menus, wine information, logos and branding is owned by or licensed to us.

  • Content may be viewed and shared for personal, non-commercial use only.

  • You must not copy, reproduce, modify, or use our content for commercial purposes without written permission.

  • Use of our photography or branding without approval is not permitted.

9. Accuracy of Information

We make every effort to ensure the information on our website is accurate and up to date. However:

  • prices, vintages, availability and event details may change

  • images are for illustrative purposes only

10. Limitation of Liability

To the maximum extent permitted by law:

  • we are not liable for indirect or consequential loss

  • our liability is limited to the value of the goods or services purchased

Nothing in these Terms limits your rights under New Zealand consumer law.

11. Privacy

Your use of this website is also governed by our Privacy Policy, which explains how we collect, store and use personal information in line with the Privacy Act 2020.

12. Changes to These Terms

We may update these Terms & Conditions from time to time. The most current version will always be available on our website.

13. Governing Law

These Terms & Conditions are governed by the laws of New Zealand, and New Zealand courts have exclusive jurisdiction.

14. Liquor License

Off-licence issued by Marlborough District Council for SCOTT FAMILY WINEMAKERS LIMITED expires on 8 April 2028.
